TERMS AND CONDITIONS OF USE
1. ABOUT OUR TERMS
1.1 These Terms explain Membership of the Commonwealth War Graves Foundation.
1.2 You should read these Terms carefully before becoming a Member.
1.3 By becoming a Member you agree to be bound by these Terms and the documents referred to in them.

1.5. DEFINITIONS
CWGC means the Commonwealth War Graves Commission, a Royal Charter organisation registered in England and Wales with number RC000136 whose principal premises are at 2 Marlow Road, Maidenhead, Berkshire, SL6 7DX, United Kingdom;
CWGF we, us or our means the Commonwealth War Graves Foundation, a Charity registered in England and Wales with the Charity Commission with registration number 1171947 and in Scotland with registration number SC051982 whose principal premises are at 2 Marlow Road, Maidenhead, Berkshire, SL6 7DX, United Kingdom;
Member means a person who has completed the registration process and pays the Minimum Donation (unless or until they cease to be a Member in accordance with any of these Terms);
Members’ Area means the restricted area of the Site only accessible to Membership members;
Membership means the CWGF membership scheme;
Membership Benefits means the benefits that Members may access or receive as determined from time to time by us,;
Minimum Donation an amount specified by us for annual access to the Membership Benefits, in accordance with clause 2.2;
Site means www.cwgc.org and all associated web pages;
Terms means these terms and conditions as updated from time to time under in accordance with clause 8; and
You or your means the person accessing or using the Site or its Content.
2. Membership Levels
2.1 TMembership allows access to the Membership Benefits. The Membership Benefits available for each level of membership are stated on the Site. The Minimum Donation required for each level of Membership is specified on the Site and may be updated from time to time.
2.2 Membership is managed and regulated by us and we reserve the right to alter or amend these Terms, the Membership Benefits or the levels of membership available, at our discretion.
3. Payment of the Minimum Donation
3.1 After you become a Member, in return for payment of the Minimum Donation, as determined by us from time to time, you will have access to the Member Benefits. If the Minimum Donation changes, this will take effect from your next renewal, in accordance with clause 3.6.
3.2 You must be aged 18 years old or over to become a Member.
3.3 You can choose to pay the Minimum Donation with a single annual payment by annual direct debit, credit or debit card, or you can pay monthly by direct debit. New Members will receive details of their payment schedule in a welcome email. Existing Members will find such details in their renewal email.
3.4 The Membership is on an annual basis whether you pay annually or monthly . Your membership shall be renewed automatically on the anniversary of your becoming a Member unless you notify us of your wish to cancel your membership at least seven days in advance. We will send you an email reminder at least 14 days before your anniversary to remind you that it will automatically continue and, if you pay by direct debit, money will be taken from your nominated account unless you cancel. This email will state the Minimum Donation for the forthcoming year.
3.5 If we are unable to collect payment from your nominated account or, if you do not pay by direct debit, you fail to make a payment we will contact you to inform you of this, following which you will cease to be a Member unless we receive payment within 14 days. If you pay monthly, we may require you to pay the Minimum Donation due for the remainder of the then current year of your membership.
3.6 If we change the Minimum Donation, this change will take effect from the next renewal of your membership and details will be included in the reminder you receive.
3.7 A refund of your Minimum Donation may be available at our discretion in limited circumstances. This may be a refund of your monthly or annual payment, depending on your method of payment and the nature of the issue. If a refund of an annual payment is requested and agreed, we will consider this to be a cancellation of your membership. However, for reasons beyond our control we are not able to issue a refund of the Minimum Donation (or any further amount you have donated) if you have opted to Gift Aid.
4. Membership Benefits
4.1 Membership allows access to the Membership Benefits available to your level of membership (please see clause 2.1)
4.2 Access to the Members’ Area may form part of the Member Benefits, at our discretion. The Members’ Area is hosted by the CWGC and access is subject to acceptance of the terms of use of the Site, available here: Term and Conditions (cwgc.org).
4.3 While we aim to ensure that all members enjoy the Membership, we cannot guarantee the availability of the Membership Benefits at all times and accept no liability for any loss due to the interruption, suspension or termination of any Membership Benefits.
4.4 While we aim to ensure that all members enjoy the Membership, we absolutely reserve the right to alter, amend, terminate or replace any Membership Benefits at any time with or without notice.
5. Member Responsibilities
5.1 You agree that you are solely responsible for:
5.1.1 all costs and expenses you may incur in relation to your Membership;
5.1.2 keeping your password and other account details confidential; and
5.1.3 keeping the contact details we hold for you up to date.
5.2 Membership is individual and non-transferrable.
5.3 All intellectual property rights in the products, communications and materials which you receive as part of your Membership either belong to us or our licensor(s). You have the right to use those items for your own personal purposes but must not use them for any other purpose(s) without our prior written permission. If you are not sure, please contact us.
5.4 We may terminate or suspend your Membership if you do not comply with any part of these Terms (for example, you fail to pay the Minimum Donation in accordance with your chosen payment schedule), any terms or policies to which they refer, any applicable law or if we consider that our brand or reputation could be damaged by your continuing to be a Member. Any termination or suspension of membership shall not give rise to a right to refund of any donation made to us.
6. Limitation on our liability
6.1 Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury), we are not legally responsible for any losses suffered by you in connection with your Membership.
7. Member Data
In order for us to fulfil our obligations under these Terms, it is necessary for us to hold certain personal data about our Members. We will always hold and process this data in accordance with our Data Protection and Privacy Policy (cwgc.org).
8. Rights of third parties
8.1 No one other than a party to these Terms and CWGC has any right to enforce any of these Terms. The operation of the Contracts (Rights of Third Parties) Act 1999 is excluded.
9.Variation
These Terms are dated 18th June 2025. No changes to these Terms are valid or have any effect unless agreed by us in writing. We reserve the right to vary these Terms from time to time. Our updated terms will be emailed to you and displayed on the Site. By continuing to use and access the Membership following such changes, you agree to be bound by any variation made by us. It is your responsibility to check these Terms from time to time to verify such variations.
10. Disputes
10.1 You may submit any concerns you have in person, by letter or email to the contact details in clause 1.4. We will try to resolve any concerns quickly and efficiently.
10.2 However, if an issue cannot be resolved and you or we wish to take further action, these Terms shall terms are governed by English law and wherever you live you and we can bring claims against one another in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in.
